UK Fake ID Law
Section 4 of the Identity Documents Act 2010 addresses possession of false identity documents with improper intention.
Section 7 defines what constitutes an identity document for the purposes of Sections 4, 5, and 6 of the Act.
Section 7(1)(f) specifies that an "identity document" includes:
"a driving licence issued by or on behalf of the authorities of a country or territory outside the United Kingdom"
Under Section 4(2), anyone convicted of possessing a fake driving licence with improper intention faces:
(a) on conviction on indictment, to imprisonment for a term not exceeding 10 years or a fine (or both), or
(b) on summary conviction, to imprisonment for a term not exceeding 12 months or a fine not exceeding the statutory maximum (or both)."
Fines and Sentences
Possession of false identity documents with improper intention (Section 4 of the Identity Documents Act 2010):
- On conviction on indictment: up to 10 years' imprisonment or a fine (or both)
- On summary conviction: up to 12 months' imprisonment (England and Wales) or 6 months (Scotland and Northern Ireland), or a fine not exceeding the statutory maximum (or both)
Possession of false identity documents without reasonable excuse (Section 6 of the Identity Documents Act 2010):
- Maximum sentence: 2 years' imprisonment
- Offence range: Band C fine to 1 year 6 months' custody
The Sentencing Council publishes detailed guidelines for judges and magistrates. Actual sentences depend on the offence category, determined by culpability and the harm caused or intended.
Sentencing ranges for possession without reasonable excuse break down as follows:
- Category 1: High culpability and greater harm – 26 weeks' to 1 year 6 months' custody
- Category 2: High culpability and lesser harm, or lower culpability and greater harm – High level community order to 26 weeks' custody
- Category 3: Lower culpability and lesser harm – Band C fine to medium level community order
